RULE NO: 65G-11.001
RULE TITLE: Developmental Disabilities Waivers Waitlist Prioritization.
PURPOSE AND EFFECT: The purpose of the rule development is to solicit public input to be used in developing a rule for the process and procedures for prioritizing the wait list for enrollment on the Developmental Disabilities Home and Community Based Services Waiver. This rule is required to implement statutory language adopted during the 2009 Florida legislative session.

WAITLIST PRIORITIZATION RULE WORKSHOP – OUTLINE FOR DISCUSSION


1) Crisis Category 1
• There is a current rule in place with three categories of homeless, danger
to self or others and caregiver unable to give care. This rule would cover
this category
• Suggestions/concerns

2) Category 2 - Children in Foster Care
• How often should match of data between the Agency for Persons with
Disabilities and Department of Children and Family be done to identify
children on APD waitlist that also have an open case with child welfare
system – quarterly? Other?
• What happens when child turn 18 and still on the waitlist for APD waiver
services?
• Other suggestions/concerns

3) Category 3 – • What is definition of caregiver?
• What documentation for caregiver condition should be required?
• How do we know if caregiver is unable to provide care?
• How to determine that there is no alternative caregiver available – is it
self reporting? Other process?
• How to distinguish this category from category 1 – is there a clear
indication, does it depend on availability of other resources that person
has access to?
• How to determine risk of incarceration, i.e., past conviction? pending
charges? What behaviors are considered to be those that put the person at
increased risk? Is change in living environment a factor?
• What behavior or physical needs place caregiver at risk?
• What determines discharge ready from Mental Health Hospital or Skilled
Nursing Facility – is a discharge plan required to be in place? How long
does the person have to be ready for discharge? What documentation is
needed?

4) Category 4 –
• Who is considered the caregiver? What is a primary caregiver? Is it a paid
caregiver? Unpaid?
• What Primary caregiver? Is there more than one? Caregiver must be related?
Must live in same home as individual?
• How to determine caregiver not available?
• Obtain information through interviews? Have to live with client?
• Is there any other situations not described in statute that should be added
to this category?

5) Category 5 - does graduation include special diploma
• Support to maintain competitive employment and how to determine?
• Transportation? Natural supports?
• Post secondary education – how to determine need support – documentation
needed?


6) Category 6 –
• Should there be an automatic update on 21st birthday? Or done annually?

7) Category 7 –
• What determines that other category criteria is not met?



Process Questions• What information/documentation is needed for each category?
• Update the prioritization how often? Annually?
• Who provides the information? What is the process?
• How is the data gathered? Face to Face? phone? other informants?
• Can people request change to prioritization status – if so how is that
done or is it an annual automatic update?
• Reconsideration – how to process a request for reconsideration
• How does a person get reprioritized?
